HTHM Posted August 9, 2011 Report Posted August 9, 2011 (edited) Might have saved his life, just sayin... "Officers discovered the male did not have a lifejacket on board and no safety equipment for the vessel." Edited August 9, 2011 by HTHM
Nipfisher Posted August 9, 2011 Report Posted August 9, 2011 Kind of a joke. Not the being drunk out on the water part (that is dangerous) but actually laying a charge? Why not take the booze, and make him walk the shoreline back home. NOt like he was miles away from where he started? Ever tried to peddal when your drunk? Takes more coordination then you think lol.
fishing n autograph Posted August 9, 2011 Report Posted August 9, 2011 Well it is impaired operation of a vessel...no different than driving a lawn tractor or golf cart drunk
irishfield Posted August 9, 2011 Report Posted August 9, 2011 Why I tell Leah to stick close to shore in her floating lounge chair... pretty soon we'll be born wrapped in bubble wrap!
fishing n autograph Posted August 9, 2011 Report Posted August 9, 2011 The actualy section states impaired operation of a motor vehicle, vessel or aircraft
irishfield Posted August 9, 2011 Report Posted August 9, 2011 Yep.. and floaty toys are supposed to be exempt from the Vessel act unless it appears you are "navigating the waterway" which leaves a real gray area if you're more than 10 feet off the shoreline.
Roy Posted August 9, 2011 Report Posted August 9, 2011 He could have just let him off and let search and rescue spend $100,000. trying to recover his body? Motor or no motor he's still endangering his and possibly other peoples' lives.
HTHM Posted August 9, 2011 Report Posted August 9, 2011 The actualy section states impaired operation of a motor vehicle, vessel or aircraft Not to start a big debate or the rightness or wrongness of a law....if I am cutting my lawn three sheets to the wind on my lawn tractor, on my own property, I can still garner a impaired charge?
irishfield Posted August 9, 2011 Report Posted August 9, 2011 Why I lock the gate when I cut the grass Albert... no entry to an Aerodrome without the Airport Managers permission, under Federal Law !
fishing n autograph Posted August 9, 2011 Report Posted August 9, 2011 Yep, a lawn tractor is considered a motor vehicle under the criminal code of canada
cram Posted August 9, 2011 Report Posted August 9, 2011 I bet the guy was checked for safety equipment, failed the attitude test, and is now going to be paying for it with an impaired charge. The guy may have had 3 beers and taken a spin in front of his cottage on a paddleboat....hardly endangering other people's lives.
cram Posted August 9, 2011 Report Posted August 9, 2011 Yep, a lawn tractor is considered a motor vehicle under the criminal code of canada Can you be charged for cutting your grass with a beer on your lawn tractor?
fishing n autograph Posted August 9, 2011 Report Posted August 9, 2011 No because the liquor license act doesn't apply on your property but if your gooned you could be done up for impaired... Ask Eddie Shack...he's been done up a bunch of times for driving his golf cart impaired

irishfield Posted August 9, 2011 Report Posted August 9, 2011 So have (ex)employees of mine during a company golf tourney..... but then again they drove all the way from the Golf course to the beer store... and part way back ! lol
cram Posted August 9, 2011 Report Posted August 9, 2011 3 beers would not make you impaired....I 4 beers then.
HTHM Posted August 9, 2011 Report Posted August 9, 2011 Yep, a lawn tractor is considered a motor vehicle under the criminal code of canada Regarding the, in my opinion, important part of the question, my own (private) property. Not getting confrontational, just trying to understand the rules. I have the understanding that one can welcome, or not welcome, a police presence onto one's property. What are the criteria for entry?
fishing n autograph Posted August 9, 2011 Report Posted August 9, 2011 If its a criminal offence taking place or a person is found committing an offence on your property then no permission is needed
fishing n autograph Posted August 9, 2011 Report Posted August 9, 2011 Example: if youre driving drunk and someone calls it in and you're found in you're drive way you still can be arrested for impaired operation
HTHM Posted August 9, 2011 Report Posted August 9, 2011 (edited) Thanks Dave! I now know something I did not, today was not a wasted day after all. Edited August 9, 2011 by HTHM
Guest ThisPlaceSucks Posted August 9, 2011 Report Posted August 9, 2011 (edited) i consider my paddleboat private property. besides, why do they put coolers on the dang things? Edited August 9, 2011 by Dr. Salvelinus
fishing n autograph Posted August 9, 2011 Report Posted August 9, 2011 Same reason they put coolers in cars...to hide the weed!
cram Posted August 9, 2011 Report Posted August 9, 2011 Big difference between someone impaired guiding 5000 lbs of steel down the road at 100kph, and a guy in a paddleboat at 2kph. One puts others lives at serious risk. The other, not so much.
cram Posted August 9, 2011 Report Posted August 9, 2011 Curious - can you get a "drinking in public" ticket for having a beer on your dock?
