brandon Posted April 8, 2007 Report Share Posted April 8, 2007 Hey Everyone. I had a question that popped in my head earlier this morning and I was wondering what your thoughts on it were. When a fish is kept as a pet in an aquarium it counts towards your possession limit....right? Now lets use bass as an example.....You catch a bass during the legal season and decide its small enough to fit in your aquarium back home and you decide to keep it as a pet.....what happens when the season closes? if the fish is not returned does this make you in possession of an out of season fish? Then, at the start of a new season, you get yourself a replacement for Harold. This time you get yourself a female...for argument's sake, let's call her Brittany. You can spend the whole season watching Brittany in the aquarium then when the season is about to close, you eat Brittany.......and it continues..... I have NO idea, Brandon. taper Posted April 8, 2007 Report Share Posted April 8, 2007 As fishmaster said you are not allowed to transport live fish and I also thought it was illegal to keep Ontario game fish in an aquarium. For example, I go fishing on the last day of walleye seaon, catch my limit, bring them home and freeze them. The next day, when season closes, I can't be charged with being in possession of out of season fish........can I? ....works for wild game as well......I have some birds in the freezer now......I don't think I'll be charged because season is closed. I'd assume since the bass is in your possession and harvested during open season, you'd be fine. First of all the authority would need a warrant, or exigent circumstances to enter your dwelling to find this bass, and I really don't think they'd waste thier time with a fish in an aquarium. POLLIWOGG Posted April 8, 2007 Report Share Posted April 8, 2007 If you have Harold in your tank you cannot catch him in a net, you cannot grab him by hand, you cannot annoy Harold at all when he is out off season but but you can catch him with a hook and line when he's in season. That means you can only clean the tank when Harold is in season. Now if Harold gets smart and won't bite anymore you may have one stinky aquarium and might want to toss him in a lake but you can't legally catch him so you have to take the tank and only when he's in season and that might not be legal as you didn't catch him angling so you might not be able to legally get rid of him. I read the Laws as stated in e-laws. 1.A conservation officer may obtain a search warrant under Part VIII of the Provincial Offences Act . 2.If a conservation officer believes on reasonable grounds that there is in a building or other place any thing that will afford evidence of an offence under this Act but that the time required to obtain a search warrant would lead to the loss, removal or destruction of the evidence, the conservation officer may, without a search warrant, enter and search the building or other place. 3.A conservation officer who is lawfully in a building or other place may, without a warrant, seize any thing that he or she believes on reasonable grounds, (a) has been obtained by the commission of an offence under this Act; ( has been used in the commission of an offence under this Act; © will afford evidence of the commission of an offence under this Act; or (d) is intermixed with a thing referred to in clause (a), ( or ©. 4. ( that entry to the dwelling has been refused or there are reasonable grounds to believe that entry will be refused. I guess YES they need a warrant BUT if they believe they need one they would have had it already... and if they don't have it already their arses are covered......so I guess in the long and short of it they don't really need one. Not legal. The question was pertaining to possession tho....... ......its right in the title! In other words, exigent circumstances. Key words are in bold to the definition of exigent. Also, check under search of a Dwelling......that may be different again, but I'm not positive in the FWCA. Need to see the definition of a dwelling first I guess. I don't have the time to check it out right now, but it will be in there. They can't just come to your door and expect you to let them in for a search without a warrant for no reason. If someone has called and told them that you have 100 walleye in your freezer, then sure, they're coming in, no questions asked. That would be reasonable, and probable grounds. I still say they don't give a rats ass whether you have a bass or any other kind of fish in your aquarium........you think they have time for something like that? I doubt it........
