I guess I should becareful of my excalmation marks and dot, dot, dots. It does sound hot headed. I keep forgetting no one can see my face....trust me its full of cheer and love and laughter.

Funny you mention that! Most Police officers do not enforce Fish and Game because we are not taught about it. But we can However this year I will be and if you like because you are a fishing goorue, you are more than welcome to park your vehicle and your buddies in my driveway while you slay the jumbo Perch in Cooks Bay!!!!! so you don't get a parking ticket..... I guess its the County of Simcoe's way of a fee.....but hey no one else is charging fishing access fees..right?
-
it has everything to do with bashing cops. As soon as I said my occupation and I was disputing the fee....the pro Essa people were saying I should be this and I should be that? Give me a break!
-
You are absolutely right! it would not be good.
-
If the 40 bucks is for garbage maybe I'll pay the 40 dollars be on the right side of the law (that's in the grey area)and I will take all my garbage down there to the blue garbage can and essa can get rid of it.
-
and aniceguy....are you a lawyer???
-
here we go.... come on everyone join "bash the cop train" Let's see how many ones you can come up with that I have not heard. Hey you wanta pay fees go for it. Do you pay the fee solopaddler. I know you fish there and I have the PM to prove it. lol
-
What im not allowed to start a thread????If it differs than yours attack the job? I knew I shouldn't have stated the occupation. Personally I don't agree with speeding tickets? There was thread on here about that a while ago. Personally I thought I was sticking up for anglers and my opinion does differ than yours. I do believe it will lead to more fees. If you get personally disturbed by those remarks ...well....sorry.lol On that note my banter is finshed....To all that don't think others will impose fees I hope your right! .... more food for thought to the Essa supporters do you really think the people that are littering and abusing the area are paying the fee? Do you think the guys who register their firearms are doing the crime?

Roy thanks, R Obanion nice point....he worked with the MNR Do you see the MNR down at the NOTTY boning people??? Has anyone had the OPP down there????? Post your story!
-
Well I guess you should go and take everyone's 40 bucks and clear them OUT!!! because it is a designated tourist canoe route and I have the book to prove it! Let's go chop chop or use the C4 what ever
-
aniceguy...kudos can you clearify a few points for me. 1. The area in question should be "navigable" because there is a well established tourist canoe route. 2. Ok forget the shoreline lets assume its all private. What about an angler who waded into the designated area? As you know the signs for the trespass to property act have several conditions they must adhere to. 3. There are conflicting subjects surrounding the issue. It seems it is written that land owners can be charged and users of the water can be charged??? 4. A fee to access the land and fish the river vs a fee to fish the river. If I access the land which Essa Township owns and I walk down with a back pack on and wade out to the middle of the river and don't start the act of fishing until in the middle of the river than I should be fine? If I walk down to the shoreline and shore fish I am trespassing? 5. In order to lay charges, there must be some significant evidence recorded by the person laying the charge...you can beat a speeding ticket if the copper doesn't know the speed of sound! 6. 40 bucks vs 50 bucks for the trespass ...I'll take the chance I might go tomorrow..hahaha

that's no exaggeration!! that's what will happen! You will be paying everywhere. Most townships have lots of people making around 13 to 25 dollars an hour that pick up a heck of a lot of garbage in a day! I know I live in a township and I see their good work. NOW i'm not saying the town should pick everyone's garbage up!
-
some posts of any dealings with the by-law officers would be greatly appreciated. Where were you? What they said? What you said? Did you pay?
-
Gerit...thanks fore pointting oot mi spellling miztakez...I posted some more info in the New post...you can have a reed.
-
and just for the record...if protesting the 40 bucks make sure you identify yourself, obey parking signs, have your fishing licence on you, and have you driver's licence, ownership, and insurance in your vehicle thank you have a nice day.

As promised I spoke with a real estate lawyer friend of mine on the weekend and she told me the following: Essa Township and any township as far as she has found do not own the water/river, or the immediate shorline. That is a legal term called "raparion rights". There are very few properties that have raparion rights that include ownership right to the water's edge. Therefore, why do anglers pay to use the river to fish when Essa doesn't own it??? Like one other said on the board....40 Bucks for people who litter??? Exactly put some by-law agents in camou and ticket the people tossing garbage everywhere???? .....and to you Gerritt........there's always one in every crowd that wants to get his two cents in at a cop. Feel better.... and for the record I do not committ assaut, robbery etc. If you want every other water body or river in Ontario to start charging feel free to pay the fees. You must be wealthy. I am not wealthy and never intend to be.... so in 20 years have fun paying 2500 bucks to fish in ontario. Hope its not an "I told you so"? so I will not be paying the 40 dollars!
-
Hey Ball9320 .....That'll be $10.99 for each one of the creek chubs. You can just pay essa township. Oh yah and each different fly you were using that'll be $2.99 each. one more small fee ............. just let essa know how long each fish was on your hook cuz that'll be $3.50 a minute.
-
I am telling you right now that there is no way that you can be found guilty of tresspassing there!!!! They can put inplace all their stupid by laws they want! They don't own the river!!! I pay for an ontario fishing licence! In Ontario you are allowed to wade and canoe and use water ways! There fore 40 dollars for garbage pick up ...I dont' think so. THe authorities know this they are just testing the water so to speak. A tresspass ticket is 50 bucks plus tax comes to 65. I will find out the just of this " who owns the shore" my friend is a realistate lawyer. I will report back on Tuesday with this info. I have heard that the OPP were called down to IVY and did not charge anyone with the offence????
-
On that note...I agree! I guess the real problem is lack of MNR enforcement officers to properly police the waterways? I would love for some legisaltion to allow other anglers to police themselves if the gov't will keep the MNR officers down in numbers and limit them to three tanks of gas in a month.
-
I am a police officer and I know the legality of the ticket. They are dead wrong. Hey Fisherman maybe every river and lake in the area should charge a fee would you like that??? Maybe Lake Simcoe could charge you 200 dollars a year and that could go to your $75dollar hole in the ice derby. If you are set up in a lawn chair on the shore you are fair game for the fee/ ticket. If you are wading you are legally allowed to do that and most of the waterways in Ontario include a substantial buffer from the middle of the river so many metres including the shoreline. WHat about a fisherman who waded down or upstream fishing from hole to hole over a couple of kms and then some by law said you have to pay to be here.....??? What about a fisherman canoeing??? doesn't make sense to me...and second point I wouldn't want to fish the Great Salmon CULL!
-
oh and bye the way the fee has gone up in the last two years if I am not mistaken from 20 to 40 bucks????? Like I said how much will it cost in twenty years?
-
I'll never pay that 40 dollars. If fishermen continue to allow this type of double dipping (fishing licence plus a permit) than in twenty years you won't be able to afford to fish anywhere. Every spot you go will cost you cash!!!! By the way Essa doesn't own the river and as long as your toes are dipped into the water they can piss off! It is not tresspassing and the ticket won't hold up in court. Infact, you don't even have to pay a tresspassing ticket. However, I would be weary of them tagging you for a parking ticket! I don't keep fish from the Notty I always do C and R, I don't litter, I don't damage property and I am respectful where I park.....screw off ESSA!!!! Navigatable waterways act.
